NOTICE: This application is for locations where water service, sewer service, or both, has not previously existed (“new service location”). If it is necessary to extend the water system, sewer system, or both, to provide services at the new service location, the Applicant must enter into Rogers Water Utilities’ Facilities Extension Contract to extend, at the Applicant’s expense, services to the new service location. All facilities extensions and new service installations must comply with the most recent edition or revision of the Standard Specifications for Construction of Public Water and Sewer Improvements in the City of Rogers and Areas Under the Jurisdiction of the Rogers Waterworks and Sewer Commission published by the Rogers Water Utilities (“Standard Specifications”), Arkansas Department of Health Rules and Regulations, the Arkansas Plumbing Code, and all other applicable statutes, laws, rules, and regulations. Installation of services at a new service location is also subject to ordinances, rules, regulations, procedures, specifications, deposits, charges and fees, rates, water service construction costs, meter connection charges, tap costs, employee and equipment rates, plan review fees, fire hydrant rental fees and charges, impact fees, access fees, sales taxes, fees for Federal Safe Drinking Water Act compliance, and any other applicable charges, costs, and fees, which are available for viewing in the Code of Ordinances of the City of Rogers, Arkansas available online at www.rogersar.gov, the Rogers Water Utilities website, www.rwu.org, or in RWU’s New Customer Packet, or equivalent document, as may be in effect at the time the Application is made. This Application is for installation of water facilities, sewer facilities, or both, at a new service location, and is not an application for water service or sewer service. To obtain water service, sewer service, or both, at the new service location, a customer must enter into Rogers Water Utilities’ Customer Service Agreement, which is available at the Rogers Water Utilities website.

By submitting this Application, Applicant agrees to pay, or cause to be paid, to RWU all applicable deposits, charges and fees, costs of facilities extensions and other contractual charges, rates, water service construction costs, meter connection charges, tap costs, employee and equipment rates, plan review fees, fire hydrant rental fees and charges, impact fees, access fees, sales taxes, fees for Federal Safe Drinking Water Act compliance, and any other applicable charges, costs, and fees in accordance with all applicable Ordinances of the City of Rogers, the rules, regulations, procedures, and specifications of the Rogers Waterworks and Sewer Commission and RWU, and any other applicable law, as they now exist or as they may be hereafter amended, said ordinances, rules, regulations, procedures, specifications, and applicable laws, being incorporated herein and made part of this Application. Applicant further agrees to comply at all times with all applicable federal and state statutes, rules, and regulations, ordinances of the City of Rogers, the rules, regulations, procedures, and specifications of the Rogers Waterworks and Sewer Commission and RWU, and all other applicable laws, as they now exist or as they may be hereafter amended, said statutes, ordinances, rules, regulations, procedures, specifications, and applicable laws being incorporated herein and made part of this Application. Nothing in this Application shall be construed to alter or vary any applicable statutes, ordinances, rules, regulations, procedures, specifications, or other applicable law, or to limit in any way the rights of Rogers Water Utilities, the Rogers Waterworks and Sewer Commission, or the City of Rogers, Arkansas under such statutes, ordinances, rules, regulations, procedures, specifications, and other applicable law. Applicant understands and agrees that Applicant’s failure to comply with the conditions listed herein above shall constitute a basis for denial of installation of services at the new service location.

AGREEMENT TO CONDUCT TRANSACTION BY ELECTRONIC MEANS

By using this website and providing my electronic signature below, I consent to conduct this transaction by electronic means pursuant to the Arkansas Uniform Electronic Transactions Act, codified at Ark. Code. Ann. § 25-32-101 et seq. I understand that I am not obligated to conduct this transaction by electronic means. I understand that I may conduct this transaction by traditional means using a paper contract signed in ink. I understand I can contact RWU and a paper contract will be provided to me. If I choose to conduct this transaction by electronic means, I understand that my electronic signature will be legally binding, just as my signature would be binding if I signed a paper contract in ink. I understand that even if I agree to conduct this transaction by electronic means, I may refuse to conduct other transactions by electronic means. By using this website and providing my electronic signature below, I agree to conduct this transaction by electronic means.
